Tanning salon used fingerprint access control, did no harm, but failed to obtain written consent
In the first settlement in a case filed under the 2008 Illinois Biometric Information Privacy Act, salon operator L.A. Tan will pay $1.5 million to members in a class action suit. The company used fingerprints for member access to facilities but did not experience a breach or harm members in any way. Thus the case sets a troubling precedent as lawyers frequently search out such cases for personal gain, while class members receive token returns.
